Clear answers for investors and families considering permanent residence through the EB‑5 Immigrant Investor Program.

EB‑5 clarified

Start with the question that matters to you.

EB‑5 combines immigration law, source-of-funds documentation and a major investment decision. These answers explain the framework. Your eligibility, timing and project choice still require an individual review.

The foundation

EB‑5 essentials

What is the EB‑5 Program?

EB‑5 is a U.S. employment-based immigrant investor category. A qualifying foreign investor places the required capital at risk in a new commercial enterprise that creates at least ten qualifying full-time jobs. The investor and eligible family members can pursue conditional permanent residence.

How much must I invest?

The standard minimum is generally US $1,050,000. The reduced amount is US $800,000 for a qualifying rural, high-unemployment-area or infrastructure investment. The statutory amounts are subject to periodic inflation adjustments, so timing matters.

Who can be included with the investor?

A principal investor may generally include a spouse and unmarried children under 21. Age calculations under the Child Status Protection Act are technical, so families with a child approaching 21 should obtain case-specific advice early.

Do I need an employer or family sponsor?

No. EB‑5 is based on the qualifying investment, lawful source of capital and required job creation. It does not require a U.S. employer to offer a job or a U.S. relative to file a family petition.

Must I operate a U.S. business every day?

Not in the usual regional-center model. Investors generally hold a limited policy-making role in the new commercial enterprise while professional managers operate the project. Direct EB‑5 investments can require a much more active operating role.

Projects, designations and risk

What is a regional center?

A regional center is an entity designated by U.S. Citizenship and Immigration Services to sponsor EB‑5 projects within an approved geographic area. Regional-center projects may pool investor capital and may use accepted economic models to count direct, indirect and induced jobs.

What are the reserved-visa categories?

The EB‑5 Reform and Integrity Act reserves 20 percent of annual EB‑5 visas for qualifying rural investments, 10 percent for high-unemployment-area investments and 2 percent for qualifying infrastructure investments. Rural petitions also receive priority processing under the statute.

Does I‑956F approval mean a project is financially safe?

No. Approval of the project filing addresses EB‑5 eligibility based on the record submitted to USCIS. It is not a financial endorsement, does not approve an individual investor’s source of funds and does not guarantee repayment or immigration approval.

Can an EB‑5 project guarantee repayment?

No. The investor’s capital must remain at risk. A project may offer collateral, guarantees from related parties, reserves or completion support, but the investment cannot guarantee the return of capital and immigration results cannot be promised.

What should I compare before selecting a project?

Important factors include the visa designation, I‑956F status, job-creation cushion, construction progress, developer experience, capital stack, sponsor equity, investment position, collateral, escrow and denial terms, project term, extension rights, conflicts of interest and repayment strategy.

How long will my money be invested?

The immigration sustainment requirement and the investment’s contractual term are separate. An offering may have a multi-year term plus extension rights. Repayment depends on the offering documents, project performance, available funds and compliance with EB‑5 rules.

Documents and filing

What are lawful source and path of funds?

The investor must document how the investment capital and related administrative fee were lawfully earned or obtained and how the money moved into the EB‑5 investment. Evidence may include tax returns, bank records, business distributions, property sales, gifts, loans, inheritances and transfer receipts.

What is Form I‑526E?

Form I‑526E is the immigrant petition used by a regional-center investor. It presents the investor’s qualifying investment and source and path of funds, and relies on the regional center’s project filing and projected job creation.

Does filing I‑526E let me live in the United States?

Not by itself. Some investors who are already in the United States in lawful status may be eligible to file Form I‑485 when a visa is available and all requirements are met. Other investors complete immigrant-visa processing through a U.S. consulate.

What is concurrent filing?

When a visa is available and the investor meets the status and admissibility rules, Form I‑485 may sometimes be filed with or while Form I‑526E is pending. The applicant may also request employment authorization and advance parole. Travel and status decisions require individual U.S. legal advice.

What is Form I‑829?

Form I‑829 asks USCIS to remove the conditions on permanent residence. It is generally filed during the 90-day period before the second anniversary of the investor becoming a conditional permanent resident and must show compliance with the investment and job-creation requirements.

Protecting the plan

Timing, travel and family

What is an EB‑5 priority date?

The priority date is generally the date USCIS properly receives the investor petition. It establishes the investor’s place in line when demand is greater than the visas available for the applicable country and category.

How can EB‑5 help protect a child from aging out?

The Child Status Protection Act may subtract the time the qualifying petition was pending from a child’s biological age when a visa becomes available. The child must also take the required action within the permitted period. It is not a permanent age freeze.

Can a spouse’s country of birth reduce a visa backlog?

Sometimes. Cross-chargeability may allow a family to use the spouse’s country of birth for visa-allocation purposes. This can be important when one spouse was born in a country with heavier EB‑5 demand. The marriage and eligibility must be documented properly.

Can I visit the United States after filing an EB‑5 petition?

An EB‑5 filing does not automatically cancel a valid visitor visa, but it can be evidence of immigrant intent. Admission is never guaranteed. A visitor must be truthful and may need to show that the particular trip is temporary and consistent with visitor status. Obtain advice before travel.

What protections did the Reform and Integrity Act add?

The Act strengthened project disclosures, promoter registration, background requirements, USCIS oversight and fund-administration or audit requirements. It also created certain protections for good-faith investors when a regional center or project participant is terminated or debarred.

Can EB‑5 lead to U.S. citizenship?

EB‑5 leads first to conditional permanent residence and then, after conditions are removed, regular permanent residence. A permanent resident may later qualify to apply for naturalization after meeting the applicable residence, physical-presence, good-character and other requirements.
