Changes to Intra-Company Transfers (ICT)
On October 3, 2024, Canadian immigration officials announced stricter eligibility requirements for Intra-Company Transferee (ICT) work permits. Significant updates to this class include:
1. Expanded Business Operations Requirement
Previously open to all qualifying multinational businesses, ICT is now restricted to companies that have operations “in at least one other country that generates revenue beyond its borders”. As a result, single-location businesses no longer qualify.
2. New Documentation Requirements
- Companies must demonstrate that the employee transfer will provide “significant benefits” to Canada.
- Transferees intending to start a business in Canada are now required to submit a business plan.
- The Canadian job offer must reflect the prevailing wage for the position.
- The requirement for one year of qualifying work experience at the foreign company can no longer be satisfied through part-time employment.
